What criteria are used to determine Section 504 eligibility?

  • A physical or mental impairment that substantially limits a major life activity within the school environment
  • Must be based on a multi-source evaluation
  • Eligibility determined on a case by case basis by a group of persons knowledgeable about the student and the meaning of evaluation data
  • If District suspects a physical impairment and does not already have a current diagnosis documented by a physician, input from a physician may be sought as part of evaluation process
  • MUST be separate finding that impairment substantially limits a major life activity

  • Have a record of such an impairment; or
